Local Attorney Faces Formal Complaint With The Attorney Grievance Commission And The Local GR Bar Association

Kevin Dengel has maintained his innocence since his arrest while working for the Grand Rapids Public Schools. He has stated several times, that Paul Mitchell, his November 2013 Trial Attorney, failed him by not submitting exculpatory evidence. Dengel was convicted in November 2013.

Later after his release, he testified at a Michigan Civil Rights Hearing held in Grand Rapids, in March, 2019, During his testimony, Dengel made the following statement: "Telephone records were entered into Michigan state records on June 3, 2015 as evidence that I could not have "tapped" two minors in the same 45 minutes on April 8, 2013.

"I had had a major surgery on March 26, 2013. I returned to Sherwood Middle School on April 8, 2013, medically disabled, and healing from the surgery. I had trouble walking and was using three different pain medications.

"The standard healing time from a lateral internal sphincterotomy is 4 - 6 weeks.

"I was back at Sherwood Middle School within 14 days. I was trying to conserve my remaining sick days, so I would not miss financial compensation.

"Paul Mitchell decided not to submit telephone records, which spanned for exactly a 60 minute time period on April 8, 2013. The telephone records place me in an enclosed classroom (in the classroom of a former co - worker). The telephone records span from Rotation 1 thru Rotation 5.

"On April 8, 2013 Sherwood Middle School was teaching the 6th thru 8th grade students strategies to make Sherwood Middle School a better school. There was a rotational exercise going on within Sherwood Middle School on April 8, 2013. The accusers in this case were rotating through six stops within the school. An example of a rotational stop would be the Gym, Hallway, Computer Lab, Sherwood Middle Cafeteria, etc, etc. Maria Lewis alleged that I "brushed" the top region of her chest while walking by her during Rotation 2. Chynice Guydon decided support the allegations of her close friend Maria Lewis. No adult witnesses have come forward to state that they observed Kevin Dengel near Maria Lewis on April 8, 2013 (in the Sherwood Middle hallway / Rotation 2). Ashley Gray (a close friend) of Maria Lewis "stated" that Kevin Dengel tapped her rear end at Rotation 5 or Rotation 6 when she was at the Sherwood Middle School drinking fountain. These allegations were made within the same 45 minutes as the allegations of Maria Lewis."

The telephone records of Kevin Dengel span from Rotation 1 through Rotation 5.

He did not have a rotational schedule on April 8, 2013.

He did not have a rotational schedule, because his medical injury exempted him from attending Positive Behavior in School on April 8, 2013. He has maintained his innocence.

"My telephone records began at 10:30 AM thru 11:31 AM on April 8, 2013. Ashley Gray would've been "tapped" at exactly 11:30AM. There is 0% probability, that a disabled person would find her and tap her rear end in eight minutes. I had no idea where Ashley Gray was located on April 8, 2013.

He has told the Grand Rapids Times, that Maria Lewis and Ashley Gray fabricated allegations against him.

"It is a fact that I worked with Joel Hugen," he said. "I did not have an idea where Maria Lewis and Ashley Gray were located in Sherwood Middle School on April 8, 2013. I was medically disabled, and did not have a rotational schedule to know the location of Maria Lewis and Ashley Gray on April 8, 2013.

Kevin Dengel stated to the Grand Rapids Times that he was wrongly convicted in November 2013 because Paul Mitchell never submitted the telephone or medical records at the November 2013 Trial.

He spoke at a March 2019 Michigan Civil Rights hearing about his wrongful conviction in November 2013 and filed a formal complaint against the November 2013 Trial Attorney with the Michigan Attorney Grievance Commission in December 2017.

The Michigan Attorney Grievance Commission (located in Detroit, Michigan) conducted an 18 - month investigation against Paul Mitchell.

Dengel filed a formal complaint alleging "improper conduct" by Attorney Paul Mitchell, who was under a lengthy investigation, but did not face a suspension or loss of his Michigan law license. Kevin was notified of the decision in August 2019.

Mr. Dengel then filed another, more recent, complaint with the Grand Rapids Bar Association in November 2019.

He asserted to the Grand Rapids Bar Association President that Paul Mitchell should not be allowed to practice law in the State of Michigan.

He reported to The Grand Rapids Times that he has contacted the Detroit ACLU and Michigan Department of Civil Rights about his May 2013 false arrest by the Grand Rapids Police.

He also stated that he had met with Grand Rapids Police Chief, Eric Payne in August 2019. Brandon Davis (the interim Grand Rapids Director of Oversight and Public Accountability) was at the meeting.

Dengel informed Police Chief Eric Payne that four minors wrote false police reports in April 2013. Their names are: all of the following: Maria Lewis, Ashley Gray, Chynice Guydon and Autumn Guydon.
